These Terms & Conditions (“Terms”) govern your enrolment in the Fluenciation course (“Course”) offered by SCOTS English College Pty Ltd ABN 91 605 117 575 (“we”, “us”, “our”, “the College”). By enrolling in the Course, you agree to these Terms and our policies, including the Cancellation & Refund Policy and Privacy Policy.
1. Your Rights Under Australian Consumer Law
1.1 Our services come with guarantees that cannot be excluded under the Australian Consumer Law (ACL). You are entitled to:

a remedy (repair, replacement, re-supply, or refund) if the service is not delivered with due care and skill, not fit for purpose, or not delivered within a reasonable time.

compensation for any reasonably foreseeable loss caused by our failure to meet a consumer guarantee.
1.2 These rights are in addition to, and do not limit, your rights under these Terms or other laws.
2. Enrolment & Acceptance

Enrolment is confirmed once we accept your application and your fees are paid.

We may refuse or cancel enrolment if eligibility criteria are not met. If this happens, we will provide a full refund of fees paid.
3. Course Delivery
-
We will provide the Course as advertised on the official webpage and brochure.

We may adjust delivery mode (e.g. online or in-person) if required, but we will ensure this does not disadvantage you.

If you request delivery at your own premises, an additional transportation fee may apply.
4. Fees & Payment

All fees are in AUD and must be paid by the due date.

Instalment options may be available by agreement.
-
Late or non-payment may result in suspension of access until paid.
5. Changes & Rescheduling
-
If you need to reschedule classes, we will make reasonable efforts to accommodate your request.

If we reschedule or cancel a class, you will be offered an alternative or a refund for the affected class.
6. Assessment & Completion
-
Assessments occur at the 20-hour and 80-hour points.
-
Certificates are issued upon satisfactory completion of course requirements.
7. Intellectual Property
-
All materials remain the intellectual property of SCOTS English College.

You may use them only for personal study and not for distribution or resale.
8. Conduct & Termination
-
You must follow reasonable rules of conduct.
-
We may suspend or cancel your enrolment if you engage in serious misconduct.
-
In such cases, refunds will be handled under the Cancellation & Refund Policy.
9. Limitation of Liability
-
Nothing in these Terms excludes your rights under the ACL.
-
To the extent permitted by law, our liability is limited to re-supplying the services or paying the cost of having them re-supplied.
10. Governing Law
These Terms are governed by the laws of New South Wales, Australia.
This Cancellation & Refund Policy (“Policy”) supplements the Terms above and applies to cancellation, withdrawal, or refund for the Fluenciation Course.
1. Cooling-Off Period
1.1 After enrolment confirmation and payment, you have a cooling-off period of 7 calendar days during which you may cancel and request a full refund of the Course Fee, provided no classes have yet commenced.
1.2 If the Course has commenced during the cooling-off period, the cooling-off right is void.
2. Withdrawal by Student
2.1 If you withdraw from the course prior to commencement, we will refund 100% of the fees paid (minus any non-refundable administration fee, if applicable).
2.2 If you withdraw after the Course has commenced but before halfway through the program (i.e. before 40 hours of instruction), you may be eligible for a pro rata refund for the unused portion of the Course, less an administration charge (e.g. 10 % of the unused portion).
2.3 If you withdraw after halfway point (after 40 hours), no refund is available for remaining classes.
2.4 Refunds will generally be processed within 30 days of confirmed withdrawal.
2.5 You must submit a written notice of withdrawal to the College (email or letter). The date of withdrawal is the date we receive your notice.
3. Cancellation or Change by College
3.1 If we cancel the Course before commencement (for operational, staffing or regulatory reasons), you will receive a full refund of all fees paid, or may transfer into a future equivalent course at no extra charge.
3.2 If we cancel or materially alter the Course (e.g. change many hours, reduce content) after commencement, you will receive a pro rata refund for unaffected classes (or be offered a transfer to an alternative schedule).
3.3 If we reschedule a class and you reasonably cannot attend the new time, you may request a makeup session or refund for that class.
4. Non-Refundable Items
4.1 The following may be non-refundable (unless required by law):

Any non-refundable administration or enrolment fee (if disclosed at enrolment).
-
Bank or transaction fees incurred in payment or refund processing.
-
Transportation or travel costs associated with in-person off-campus sessions that have been delivered or incurred.
4.2 Any cancellation or request for variation made at very short notice (e.g. less than 24 hours before scheduled class) may forfeit the fee for that class (i.e. no refund for that class) at the College’s discretion.
5. Refund Method & Timing
5.1 Refunds will be made to the original payment method (where possible) or by bank transfer into a nominated account.
5.2 We aim to process refunds within 30 calendar days of finalising the withdrawal or cancellation eligibility.
5.3 Interest is not payable on refunds.
6. Disputes Over Refunds
If you dispute the refund amount, please submit your complaint in writing (with supporting documents). We will assess and respond within a reasonable timeframe. If unresolved, you may use mediation or legal processes under relevant consumer protection laws.
7. Special Circumstances
In rare cases (e.g. serious illness, death, significant personal hardship), at the College’s discretion, we may deviate from this Policy and grant a refund or credit of part of the fees, subject to supporting documentation (e.g. medical certificate).

To begin studying at Scots English College, you need to:
- Be 18 years old or older
- Complete a placement test to assess your current level of language proficiency or provide previous evidence of English proficiency, for example, a certificate from another ELICOS provider, an IELTS, TOEIC or TOEFL certificate (or equivalent)
- Please be aware that the English language skills level required by Scots English College may be different from the level of skills required for your student visa application. Your progress through the levels is based on your performance.
